Court of Protection & Deputyship Applications

Those who have suffered a severe brain injury or illness, have dementia or have severe learning disabilities may lack mental capacity. Our team’s experience and depth of knowledge mean that we’re well-placed to support you through what’s involved with the Court of Protection and Deputyship application process. We firmly believe that cutting through the legal jargon and explaining things clearly and straightforwardly is very important to all concerned.

There are two types of Deputyship that you can apply for:

  1. Property and Financial Affairs: Used to pay bills and organise the individual’s finances;
  2. Personal Welfare: For making decisions about medical treatment and how the person is looked after.

Official Fees & Our Costs

A Deputyship application can take up to six months to complete and can include a Court of Application fee of up to £365.00 (fees correct as of June 2020). This fee may be exempted or reduced depending on the number of assets and income of the person lacking capacity.

Depending on the case’s complexity, our fees would be approximately £950.00 plus VAT.

Disputes

Unfortunately, there may be disputes involving a conflict of opinion between loved ones or family members. Experienced members of our team are also available to advise and support you should a dispute arise.
